These terms of use ('Terms') govern your access to and use of the CLARAS website ('the Site'). Please read these Terms carefully before using the Site. By accessing or using the Site in any way, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

Service description

CLARAS is an online platform that connects users in need of plumbing services ('Users') with plumbing professionals ('Plumbers') in order to facilitate the scheduling of appointments and the provision of services. Please note that CLARAS is not itself a plumbing company and does not directly provide plumbing services. CLARAS' role is limited to facilitating contact between Users and Plumbers.

Use of the Site

a. Eligibility: You represent and warrant that you are at least 18 years of age and have the right, power and authority to enter into these Terms and to use the Site in accordance with these Terms.

b. Lawful Use: You agree to use the Site in accordance with all applicable laws, rules and regulations. You may not use the Site for any unlawful, fraudulent or harmful purpose. You may not interfere with the normal operation of the Site or attempt to gain unauthorized access to secure areas of the Site.

c. User Content: You may submit content to the Site, including requests for services and reviews of Plumbers. You are solely responsible for any content you submit and you warrant that you have all necessary rights to submit such content. CLARAS reserves the right to remove any content that violates these Terms or is otherwise inappropriate.

Liability

a. Limitation of Liability: Your use of the Site is at your sole risk. CLARAS does not warrant the accuracy, reliability or completeness of the content available on the Site. CLARAS shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the Site.

b. Plumber Independence: Plumbers are independent professionals and are not employees of CLARAS. CLARAS does not control and assumes no responsibility for the actions, omissions or services provided by Plumbers. You acknowledge that CLARAS does not guarantee the availability or quality of services provided by Plumbers.

Intellectual property rights

All intellectual property rights relating to the Site and its contents (including, but not limited to, text, graphics, logos, images, videos, etc.) belong to CLARAS or its licensors. You may not use, copy, reproduce, distribute or create derivative works from the content of the Site without the prior written permission of CLARAS.

Modification of the Conditions

CLARAS reserves the right to modify these Terms at any time. Modifications will come into effect as soon as they are published on the Site. It is your responsibility to regularly review the Terms to familiarize yourself with any changes. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.

Miscellaneous provisions

a. Entire Agreement: These Terms constitute the entire agreement between you and CLARAS with respect to your use of the Site and supersede all prior or contemporaneous agreements.

b. Governing Law and Jurisdiction: These Terms are governed by the laws of Quebec. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec.
